These Terms of Service ("Terms") govern your use of the Saporea mobile application (the "App") and related services (together, the "Service"), provided by Dmitrii Skrylev, an individual developer ("Saporea", "we", "us", or "our").
Please read these Terms carefully. By downloading or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.
1. Definitions
- App — the Saporea application for iOS.
- Service — the App together with our servers, AI processing, and the shared catalog.
- Content — menus, dishes, descriptions, photos, taste data, and other material available in or generated by the Service.
- Catalog — the shared, community database of restaurants, menus, and dishes that all users read from and contribute to.
- You — the person using the App.
2. Eligibility and Acceptance
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian. By using the App you represent that you meet these requirements and have the legal capacity to enter into these Terms.
3. License to Use the App
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. You may not:
- copy, modify, reverse-engineer, decompile, or create derivative works of the App;
- scrape, bulk-export, or resell the Catalog or any Content;
- use the Service to build a competing product or dataset;
- use the Service unlawfully or in a way that harms the Service or other users.
4. Subscriptions and Payments
Saporea offers optional paid subscriptions (Saporea Pro and Saporea Pro+) that unlock smart cloud scanning, the AI waiter, and larger cloud allowances. On-device scanning and the on-device waiter are free.
- Billing. Subscriptions are billed through your Apple App Store account at the price shown at purchase.
- Auto-renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends. Your account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling. You can manage or cancel your subscription in your Apple ID account settings. Deleting the App does not cancel a subscription.
- Free allowances. Free use, trials, and cloud-scan allowances may change over time. Unused allowances do not roll over.
- Refunds. Purchases are handled by Apple and are subject to Apple's refund policies; we generally cannot issue refunds directly.
5. The Community Catalog and Your Contributions
The Service is powered by a shared Catalog. When you scan a menu, the restaurant, menu, and dish information you contribute becomes part of the Catalog so that other diners benefit, just as you benefit from menus others have scanned.
By contributing, you:
- represent that you are permitted to photograph the menu and contribute it;
- grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to host, store, reproduce, process, adapt, and display the contributed menu and dish information as part of the Service and Catalog.
Your private data (history, favorites, taste profile, dietary needs, order drafts) is not part of the public Catalog and is handled as described in the Privacy Policy.
6. AI-Assisted Content — Important Disclaimer
The Service uses AI to read menus and to generate dish descriptions, ingredients, nutrition estimates, allergen and dietary flags, taste-match scores, and translations. Dish photos are representative stock images from Unsplash and Pexels and may not depict the actual dish.
All of this information is AI-generated or AI-assisted, is provided for general guidance only, may be incomplete or inaccurate, and is not professional dietary, nutritional, medical, or allergy advice.
⚠️ Allergies and dietary restrictions: Never rely on Saporea to determine whether a dish is safe for you. Allergen and dietary detection is best-effort and can be wrong. Always confirm ingredients, preparation, and allergens directly with the restaurant before ordering or eating. You are solely responsible for your food choices.
7. Acceptable Use
You agree not to:
- upload content that is unlawful, infringing, or that you have no right to upload;
- attempt to disrupt, overload, or gain unauthorized access to the Service;
- misuse the AI features (for example, to generate harmful or unlawful content);
- impersonate others or misrepresent your affiliation.
We may remove content or suspend access that we reasonably believe violates these Terms.
8. Intellectual Property
The App, the Service, and all related software, design, trademarks, and branding (including "Saporea") are owned by us or our licensors and are protected by law. Except for the limited license granted above, these Terms do not transfer any rights to you. Stock dish photos remain the property of their respective photographers and platforms (Unsplash, Pexels) and are used under their licenses.
9. Third-Party Services
The Service relies on third parties (including Anthropic, Google Firebase, Google Places, RevenueCat, Apple, Unsplash, and Pexels) and may link to third-party content. We are not responsible for third-party services or content, and your use of them may be subject to their own terms.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any Content (including AI-generated content) is accurate or reliable.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM, OR (ii) USD $100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Saporea and its operators from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service, your contributed content, or your violation of these Terms or applicable law.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we discontinue the Service. You may stop using the App at any time. Provisions that by their nature should survive termination (including IP, disclaimers, limitation of liability, and indemnification) will survive.
14. Governing Law, Arbitration, and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions in this section.
Informal resolution first. Before bringing any formal claim, you agree to first try to resolve the dispute informally by emailing us at zivou4@gmail.com and giving us at least 30 days to respond.
Binding arbitration. If we cannot resolve the dispute informally, you and Saporea agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court — except that either party may instead bring an individual claim in small-claims court. The arbitration will be held in Texas, or by telephone/video or on written submissions where the rules allow, and judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. You and Saporea agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of a class or representative proceeding.
30-day opt-out. You may opt out of this arbitration agreement and class-action waiver by emailing zivou4@gmail.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms.
If you opt out, or to the extent any dispute is found not subject to arbitration, that dispute will be brought exclusively in the state or federal courts located in Texas, and you and Saporea consent to the personal jurisdiction of those courts — unless mandatory local consumer-protection law provides otherwise. Nothing in this section limits rights you may have under the mandatory law of your country of residence.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. For material changes we will provide reasonable notice (for example, in-App). Your continued use of the Service after the changes take effect constitutes acceptance.
16. Apple App Store Terms
Your use of the App is also subject to Apple's Standard End User License Agreement (EULA). Where these Terms conflict with Apple's EULA in a way that reduces your rights under the EULA, the EULA prevails. You acknowledge that these Terms are between you and Saporea only, not Apple, and that Apple is not responsible for the App or its content.
